Application Terms of Use

These terms govern access to the NicheObserver web application operated by Overdrive Assets.

2. Using NicheObserver

NicheObserver provides tools for researching websites, technologies, advertising and creators, and for organizing that research. By using the application, you agree to these terms. If you use it for an organization, you must have authority to do so.

Pre-launch access is limited to invited users. Features and availability may change during this period. Creating an account or signing in with Google does not by itself purchase a subscription. Any paid service is subject to the price, limits and payment conditions presented before you order it.

By continuing through account registration, you accept these terms and acknowledge the application privacy policy linked on that screen. Product updates by email are an account preference enabled by default where permitted by law. You can disable them during registration, in account settings or through the unsubscribe link in every product-update message.

3. Your account

Provide accurate account information and protect your password, sessions and API keys. Use only accounts and credentials you are authorized to use. Inform us if you suspect unauthorized access. Google sign-in is an optional authentication method; your Google account remains subject to Google's own terms.

4. Permitted use

Use the service lawfully and respect third-party privacy and intellectual-property rights. You must not bypass authentication or usage limits, access another user's private data, test credentials that are not yours, interfere with the service or use it for unlawful surveillance, harassment or unsolicited communications that violate applicable law.

5. Research data and your content

Reports may include information from public sources, crawled pages and licensed datasets. Their coverage, freshness and accuracy vary. Verify material findings before making decisions; a detected signal does not establish a contractual relationship or guarantee that a website or business is active.

You retain your rights in the content you submit. You authorize Overdrive Assets to store and process it as needed to provide the features you request. Access to the service does not transfer ownership of NicheObserver software, branding or third-party datasets.

6. Privacy

The application privacy policy explains how we handle account information, Google sign-in data, saved research and service logs, including your choices and how to request deletion.

7. Availability and account closure

We may carry out maintenance, change features or restrict access where necessary to address abuse, security risks or breaches of these terms. You can stop using the service at any time and request account closure at [email protected].

Applicable mandatory rights remain unaffected. Nothing in these terms excludes a right or liability that cannot lawfully be excluded.
